About us
These terms are issued by Cleancut Garden & Property Maintenance Ltd, based in East Kilbride, Scotland.
- Website: www.cleancutltd.com
- Email: mail@cleancutltd.com
- Telephone: 07398 850023
Scope
These terms govern:
- Use of the public website
- Quote and estimate requests
- Acceptance of quotations and booking of work
- One-off and recurring services
- Use of the customer portal
- Invoices and payments, including AutoPay where you have set it up
A written quotation may also set out job-specific scope, notes or terms. Where a quotation is more specific about the work, access, materials or price, those details apply to that job. These general terms apply alongside that quotation and do not replace statutory consumer rights.
Quotes and estimates
Quotations and instant estimates are based on the information available at the time, including details you supply about the property and the work. Please make sure that information is accurate.
If the scope changes, or site conditions are materially different from what we were told or could reasonably see, we may need to revise the price or agree extra work before continuing.
A quotation remains valid until the date shown on it. Instant website estimates — including Christmas light estimates — are a guide for the selections you make. We review them and confirm the final price and date before the work is booked. An estimate request is not a confirmed booking and nothing is payable when you send it.
Booking and contract formation
A quotation can be accepted online by typing your name and confirming acceptance, or by another clear confirmation we record (for example by email or telephone). When you accept online we record your typed name, the time of acceptance and limited technical audit information.
Accepting a quotation is an offer to proceed with the work described at the price shown. We will then be in touch about scheduling. A booking is confirmed when we confirm the visit or job with you, including by a booking-confirmation message where we send one.
We do not require a deposit unless a particular quotation says so.
Customer responsibilities
You agree to:
- Give accurate contact and property details
- Provide safe and reasonable access at the agreed time
- Tell us about relevant hazards or restrictions before we attend
- Keep pets and avoidable obstructions away from the work area where needed for a safe visit
- Obtain any permission needed if you are not the property owner
- Make water or electricity available where the booked work reasonably requires it and this has been agreed
Access
If we cannot reasonably access the property — for example because a gate is locked, vehicles block the work area, or we were not told about a restriction — we will try to contact you and rearrange the visit.
We do not apply an automatic call-out charge in these terms. If a wasted visit has a cost consequence, we will discuss that with you rather than apply a hidden fee.
Weather and circumstances outside our control
Outdoor work may be delayed or rearranged if conditions are unsafe or would prevent a proper job. That includes severe weather, waterlogged or frozen ground, access restrictions, equipment failure and other circumstances beyond reasonable control.
We will make reasonable efforts to let you know and to rearrange. We cannot guarantee that outdoor work will take place on a particular date regardless of conditions.
Recurring services
Recurring garden or grounds maintenance is provided at the frequency and price agreed with you. That may be weekly, fortnightly, every three weeks, monthly, or another arrangement we confirm.
Actual visit dates can vary because of weather, bank holidays, operational circumstances or a request from you. A preferred day is a planning guide, not a guarantee of the same calendar date each cycle.
There is no minimum contract period in these terms. You can ask us to pause or cancel a recurring service by contacting us or, where the portal offers it, by submitting a cancellation request. We will confirm when the change takes effect. Outstanding invoices and completed visits remain payable.
One-off work
One-off jobs follow the accepted quotation or confirmed booking. Work outside that agreed scope needs a further agreement and may cost extra.
Materials
Where Cleancut supplies materials, they form part of the agreed price unless the quotation says they are extra or to be confirmed. These terms do not add restocking charges.
Pricing
Prices are as quoted or otherwise agreed with you.
Cleancut is not currently VAT registered. VAT is not added to our prices or invoices unless that position changes. If VAT registration changes, we will say so on affected quotations and invoices.
Invoices and payment
We issue invoices for work and recurring services as agreed. Each invoice shows the amount due and the due date. Please use the invoice number as the payment reference unless we give you a different reference.
Payment methods we support are:
- Online card payment through Stripe, from a public invoice link, Quick Pay or the customer portal
- Bank transfer, where bank details are shown on the invoice or otherwise provided
- Another method we have agreed with you, such as cash on a visit where that is arranged
These terms do not add late-payment interest or collection charges for consumer customers. If an invoice is overdue we may send a reminder and ask you to settle the outstanding amount.
AutoPay
If you enable AutoPay in the customer portal, you authorise Cleancut to charge the saved payment method for the service and amount shown in the AutoPay confirmation. The payment method is stored and charged by Stripe.
Depending on the service, that may be a charge after each completed visit, or a fixed monthly amount on an agreed day. A monthly plan charge is not based on how many visits took place in that month.
You can pause AutoPay, and manage or replace the saved card, in the customer portal. If a price changes, AutoPay will not collect the new amount until you confirm it. Turning AutoPay off does not cancel the underlying service or any invoice that is already due.
Cancellations and rescheduling
Operational changes
If you need to rearrange or cancel a visit, please contact us as soon as you can. We will do what we reasonably can to move the work. You can also request cancellation of an ongoing service through the customer portal. That request is reviewed by Cleancut; it is not an instant cancellation until we confirm it.
Consumer cooling-off rights
If you are a consumer and you book with us at a distance (for example online or by telephone) or away from our premises, you may have a legal right to cancel within 14 days under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
To use that right, contact us clearly within the 14 days using the details above. You do not have to use a particular form of words.
That statutory right is affected once work begins:
- If you ask us to start during the 14 days, you may still cancel, but you may need to pay a reasonable amount for work already carried out
- If the service has been fully performed, the statutory cancellation right ends
Accepting a quote does not waive rights you cannot legally give up. You do not have to ask us to start during the cancellation period as part of ordinary quote acceptance. If you later ask Cleancut to begin qualifying work during that period, different rules may apply: you may need to pay a reasonable amount for work already carried out if you then cancel, and if the service is fully completed during the period you may lose the right to cancel. These consumer rights are in addition to ordinary rearranging of visits. Bookings are not described as non-refundable.
Completed work and problems
If something is not right, please contact us promptly and we will look into it. Where a concern is reasonable, we will try to put it right.
Telling us quickly helps us attend while the issue is still clear, but there is no short deadline in these terms that takes away your statutory rights.
Damage and liability
Cleancut is not responsible for loss or damage caused by:
- Inaccurate information you supplied
- Hazards or restrictions you did not tell us about
- Pre-existing defects or damage
- Circumstances outside reasonable control, including the weather events described above
Nothing in these terms excludes or limits liability that cannot lawfully be excluded. That includes liability for death or personal injury caused by our negligence, and for fraud or fraudulent misrepresentation.
We do not exclude all liability for our work. We are responsible for loss we cause by failing to take reasonable care, subject to the limits the law allows.
Your property
Please tell us, before we start, about anything that could be damaged or is not obvious, including:
- Hidden cables, pipes or irrigation
- Fragile items in the work area
- Underground or hidden garden features
- Known hazards such as unstable structures or steep drops
We take reasonable care, but we cannot accept responsibility for damage to features we were not told about and could not reasonably have been expected to see.
Waste and debris
Removal or disposal of green waste and debris is only included where the quotation or agreed scope says so. These terms do not promise that all arisings will be taken away after every visit.
Photos
We may take photographs connected with quotes, jobs and completed work. Typical uses include documenting the work, before-and-after records, quoting or assessment, and customer service. We may also use suitable photographs of the work itself to show examples of our services. Most of those examples show the work rather than customer names or obvious identifying features of the property.
If we intend to use a photograph that clearly identifies a customer, a property, or another material private detail, we will ask for permission where appropriate. Accepting a quote or these terms does not give Cleancut unrestricted rights to use photographs of you or your property for advertising. Photos you upload with an estimate are used to review that request, not as marketing content.
Customer portal
The customer portal lets you view and manage account information, including properties, services, quotes, invoices, payments, files we have shared with you, notifications and, where available, AutoPay and cancellation requests.
You must:
- Use the portal only for your own Cleancut account
- Keep login details secure
- Keep contact information reasonably accurate
- Tell us if you think the account has been misused
We aim to keep the portal available but do not guarantee uninterrupted access. Maintenance, faults or events outside our control may take it offline from time to time.
Website content
Website content is for general information about our services. We take reasonable care to keep it accurate, but it is not a quotation or a promise that a particular service is available on a particular date.
We do not guarantee that the website will always be available or free of errors. External links are provided for convenience and we are not responsible for third-party sites.
Intellectual property
Cleancut’s name, branding, website text, original imagery and design belong to us or our licensors. You may not copy them for commercial use without permission, except as allowed by law. We do not claim ownership of third-party material that appears on or is linked from the site, such as Google reviews or payment pages.
Privacy and cookies
How we use personal information is explained in our Privacy Policy. Cookies and similar storage are explained in our Cookie Policy.
Changes to these terms
We may update these terms for future website use and future work. The latest version and the date at the top of this page will be the current one.
Changes do not rewrite a quotation or booking that has already been accepted, unless we both agree or the law requires it.
Governing law
These terms are governed by the law of Scotland.
If you are a consumer, you also keep any mandatory rights about where a claim may be brought. These terms do not require consumers to use a court that would take away those rights.
